Welcome to NOMINOOK. These Terms of Service ("Terms") govern how you access and use our website, products, and services. By placing an order, creating an account, or using our website, you're agreeing to be bound by these Terms. If you don't agree with them, please don't use our services.
1. About Us
NOMINOOK is a direct-to-consumer pet dental care brand, offering probiotic dental chews for dogs and silvervine dental sticks for cats. Throughout these Terms, "NOMINOOK," "we," "us," and "our" refer to the operator of nominook.com. "You" and "your" refer to anyone accessing our website or purchasing our products.

2. Eligibility
To purchase from NOMINOOK, you need to be at least 18 years old and capable of entering into a legally binding contract. By placing an order, you're confirming that you meet these requirements and that the information you've provided is accurate and complete.
3. Products
Our products are designed as dental care supplements for healthy dogs and cats. They're not a substitute for veterinary care or professional advice. If your pet has an existing health condition, is pregnant, is on medication, or is very young or elderly, check with your veterinarian before use.
We take reasonable care to keep product descriptions, ingredients, images, and claims on our website accurate, though colours, packaging, and minor details may vary slightly from what you see on screen. We reserve the right to update product formulations, packaging, and specifications over time.
4. Orders and Acceptance
Placing an order is an offer to purchase products at the listed prices. Your order is only accepted once we send you an order confirmation email. Until that point, we may decline or cancel your order for reasons that include:
- The product is out of stock or discontinued
- There's an error in the price or product description
- We can't verify your payment or delivery details
- We suspect fraud or unauthorised use of a payment method
- The order breaches these Terms
If we cancel an order that's already been paid for, we'll refund the amount charged to your original payment method.
5. Pricing and Payment
All prices are shown in the currency displayed at checkout and include GST where applicable. Shipping costs, where they apply, are calculated and shown at checkout before you finalise your order.
We accept the payment methods listed at checkout. By providing your payment details, you're confirming that you're authorised to use that payment method and that the information you've given us is accurate.
We reserve the right to change our prices at any time, though this won't affect orders that have already been confirmed. If a pricing error occurs, we may cancel the affected order and issue a full refund.
6. Subscriptions
Some of our products are available on a recurring subscription. Starting a subscription authorises us to automatically charge your payment method at the interval you've chosen (monthly, or every 60 days, for example) until you cancel.
A few things worth knowing about subscriptions:
- Your subscription continues automatically until you cancel or pause it.
- You can manage, pause, skip, or cancel your subscription anytime through your customer account, or by emailing hello@nomnook.com.
- Cancellations or changes need to be made before your next order is processed. Once an order has been billed and processed, it will ship.
- We'll notify you of any material changes to subscription pricing before they take effect.
- Promotional or introductory pricing applies only to your first order, unless stated otherwise. Later orders are charged at the standard subscription rate.
7. Delivery
Delivery timeframes shown at checkout are estimates, not guarantees. Once your order leaves our warehouse, it's handled by third-party couriers, and delays outside our control can happen.
Risk in the products passes to you once they're delivered to the address you provided at checkout. It's your responsibility to make sure that address is accurate and that someone's available to receive the parcel where needed.
8. Returns and Refunds
Returns and refunds are governed by our Return & Refund Policy, which forms part of these Terms. In short: we don't accept change of mind returns, but we will replace, refund, or otherwise make good on faulty, damaged, or incorrect orders in line with the Australian Consumer Law.
9. Accounts
If you create a customer account with us, you're responsible for:
- Providing accurate and current information
- Keeping your login credentials secure
- All activity that happens under your account

10. Acceptable Use
You agree not to use our website or services to:
- Breach any law, regulation, or third-party right
- Post false, misleading, defamatory, or harmful content
- Interfere with the operation or security of our website
- Attempt to gain unauthorised access to our systems or other users' accounts
- Use automated tools (scrapers, bots, crawlers) to collect data from our website without our written permission
- Resell our products commercially without our prior written consent
We reserve the right to refuse service, cancel orders, close accounts, and remove content at our discretion.
11. Intellectual Property
All content on our website, including the NOMINOOK name, logo, product names, images, text, graphics, videos, and design, is owned by us or our licensors and is protected under intellectual property law. You're granted a limited, non-exclusive, non-transferable licence to view and use this content for personal, non-commercial purposes only.
You may not reproduce, distribute, modify, publish, or use our content commercially without our prior written consent.
12. User-Generated Content
If you submit reviews, photos, videos, comments, or other content to us (through product reviews, social media tags, or emails, for example), you're granting NOMINOOK a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, publish, and display that content across our marketing channels, including our website, social media, email, and paid advertising.
You confirm that anything you submit is your own work, doesn't breach anyone else's rights, and doesn't contain anything unlawful, misleading, or offensive.
13. Third-Party Links and Services
Our website may link to third-party websites or services. We don't control, and aren't responsible for, the content, policies, or practices of those third parties. Visiting third-party sites is at your own risk.
14. Disclaimers
Our website and products are provided "as is." To the fullest extent the law allows, we don't make any warranties or representations about the accuracy, completeness, or availability of our website, or about our products being fit for any purpose beyond what's stated in the product description.
Nothing in these Terms excludes, restricts, or modifies any rights or guarantees you hold under the Australian Consumer Law that can't lawfully be excluded.
15. Limitation of Liability
To the fullest extent the law allows, our total liability for any claim arising from these Terms, your use of our website, or any product you've purchased from us is limited, at our discretion, to one of the following:
- Replacing the product
- Supplying an equivalent product
- Refunding the price you paid for the product
We're not liable for indirect, consequential, incidental, or special loss or damage, including loss of profits, loss of data, or veterinary expenses, except where the law doesn't allow us to exclude that liability.
16. Indemnity
You agree to indemnify and hold NOMINOOK, along with its directors, employees, and agents, harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, misuse of our products, or violation of any law or third-party right.
17. Changes to These Terms
We may update these Terms from time to time. The most current version will always be available on our website, with the "Last updated" date reflecting the latest revision. Continuing to use our website or services after changes take effect means you accept the updated Terms. For material changes affecting active subscriptions, we'll notify subscribers by email beforehand.
18. Governing Law
These Terms are governed by the laws of Queensland, Australia. You and NOMINOOK both submit to the exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia for any dispute connected to these Terms.
19. General
If any part of these Terms turns out to be unenforceable, the rest will remain in effect. If we don't enforce a provision at some point, that doesn't mean we give up the right to enforce it later. Together with our Return & Refund Policy and Privacy Policy, these Terms make up the entire agreement between you and NOMINOOK regarding your use of our website and products.
